1. General information

The Urban Planning Legislation course is part of the Civil Engineering Degree Curriculum taught at the Polytechnic University School of La Almunia de Doña Godina. This is an elective subject of 6 credits ECTS that is taught in the fourth year of the degree.

The acquisition of the learning results of the subject provides training and competence to contribute to some extent to the achievement of each and every one of the Sustainable Development Goals (SDGs) of the United Nations Agenda 2030 (https://www.un.org/sustainabledevelopment/es/).

  • Goal 11:  Making cities more inclusive, safe, resilient and sustainable

 

Specific goals

  • Target 11.3: By 2030, increase inclusive and sustainable urbanization and capacity for participatory, integrated and sustainable human settlements planning and management in all countries

2. Learning results

  • To understand the scope and transcendence that urban planning practice has had throughout history and its repercussion in today's society.
  • Identify and differentiate the different legal norms applicable in the practice of Aragonese urban planning.
  • To understand the procedure for the elaboration and approval of the most characteristic planning instruments of Aragonese urban planning.
  • Handle with ease and interpret the content of urban planning instruments regulated in the Aragonese regulations.
  • Identify the influence of urban planning on land use and real estate valuation.
  • Create, handle with fluency and interpret the most characteristic management instruments of Aragonese urban planning and apply them to practical cases.
  • Understand and use techniques for the promotion, management and control of urban and environmental legality.
  • Acquire elements of judgment for making informed and responsible decisions in urban and environmental matters.

3. Syllabus

  • Urban Planning: Fact and Law. Historical evolution of Spanish urban development law.
  • Concept and content of Aragonese urban law.
  • Urban planning instruments: general plan, partial plan, special plans, detailed studies, delimitations of urban land.
  • Technical planning standard.
  • Urban management instruments: isolated and integrated actions. Reparcelling and urbanization project Intervention in building and use of land and subsoil: licenses, responsible declarations, prior communications . Ruin and the duty of conservation.
  • Protection of urban legality.

  • Urban sanctioning law: infractions and sanctions.

4. Academic activities

Theoretical sessions

  • Presentation and commentary on the basic concepts of the subject.

 

Practical sessions

  • On-line localization of the urban planning law in force in Aragon and of a general urban planning instrument.
  • Use of spatial data infrastructures and various urban and geographic information systems of both public and private initiative.
  • Carrying out exercises of reserve module calculations according to the provisions of the urban planning legislation of

Aragón in force.

  • Carrying out exercises for the reparcelling of an execution unit.
  • Viewing and critique of videos of recent urban development actions, both for the development of urban land and the transformation of unconsolidated urban land.

5. Assessment system

The assessment will be carried out on the basis of two aspects:

  • assessment of the theoretical and practical knowledge of the student and
  • oral defense of a paper.

 

Standards with respect to work:

The work will focus on the analysis and commentary of an urban planning instrument in force.

The work will be presented in writing and defended orally.

The grade of the work will represent 20% of the final grade of the subject.

For the assessment of this test will be taken into account the capacity of synthesis, the clarity of the exposition, the agile use of specialized terminology and the use of appropriate audiovisual means

Standards assessment of theoretical and practical knowledge:

In order to obtain a positive assessment, the student must meet one of these two conditions:

  • Pass a final exam (score of 5 or higher) to be held on the official exam schedule date exams.
  • Pass two mid-term exams to be taken throughout the course (obtain an average of 5 between the two; this rule will not be applied if any of them is rated below 4).

 

In the evaluation of this part will be taken into account not only the adequacy of the student's answers to the content of the subject, but also the grammatical and spelling clarity in its exposition.

The grade for this part will represent 80% of the grade for the subject

1. Información básica de la asignatura

La asignatura de Legislación Urbanística forma parte del Plan de Estudios del Grado en Ingeniería Civil que se imparte en la Escuela Universitaria Politécnica de La Almunia de Doña Godina. Se trata de una asignatura optativa  de 6 créditos ECTS que se imparte en el cuarto curso de la carrera.

En relación con los Objetivos de Desarrollo Sostenible (ODS) de la Agenda 2030 de Naciones Unidas, la adquisición de los resultados de aprendizaje de la asignatura proporcionan capacitación y competencia para contribuir en cierta medida al logro de:

  • Objetivo 11:  Lograr que las ciudades sean más inclusivas, seguras, resilientes y sostenibles

Metas específicas

  • Meta 11.3: De aquí a 2030, aumentar la urbanización inclusiva y sostenible y la capacidad para la planificación y la gestión participativas, integradas y sostenibles de los asentamientos humanos en todos los países

2. Resultados de aprendizaje

  • Comprender el alcance y trascendencia que la práctica urbanística ha tenido a lo largo de la historia y su repercusión en la sociedad actual.
  • Identificar y diferenciar las distintas normas legales aplicables en la práctica del urbanismo aragonés.
  • Entender el procedimiento de elaboración y aprobación de los instrumentos de ordenación más característicos del urbanismo aragonés,
  • Manejar con soltura e interpretar el contenido de los instrumentos de planeamiento urbanístico regulado en la normativa aragonesa.
  • Identificar la influencia del planeamiento urbanístico en el uso del suelo y en la valoración de los bienes inmuebles.
  • Crear, manejar con soltura e interpretar los instrumentos de gestión más característicos del urbanismo aragonés y aplicarlos a casos prácticos.
  • Comprender y emplear técnicas para el impulso, gestión y control de la legalidad urbanística y medioambiental.
  • Adquirir elementos de juicio para la toma de decisiones fundadas y responsables en materia urbanística y medioambiental.

3. Programa de la asignatura

  • El Urbanismo: Hecho y Derecho. Evolución histórica del Derecho urbanístico español.
  • Concepto y contenido del Derecho urbanístico aragonés.
  • Instrumentos de ordenación urbanística: plan general, plan parcial, planes especiales, estudios de detalle, delimitaciones del suelo urbano. 
  • Norma técnica de planeamiento.
  • Instrumentos de gestión urbanística: actuaciones aisladas e integradas. Reparcelación y proyecto de urbanización
  • Intervención en la edificación y uso del suelo y subsuelo: licencias, declaraciones responsables, comunicaciones previas. La ruina y el deber de conservación.
  • Protección de la legalidad urbanística.
  • Derecho urbanístico sancionador: infracciones y sanciones. 

4. Actividades académicas

Sesiones teóricas

  • Exposición y comentario de los conceptos básicos de la asignatura.

Sesiones prácticas

  • Localización on-line de la ley de urbanismo vigente en Aragón y de un instrumento de planeamiento urbanístico general.
  • Utilización de infraestructuras de datos espaciales y sistemas de información urbanística y geográfica variados tanto de iniciativa pública como privada.
  • Realización de ejercicios de cálculos de módulos de reserva según lo establecido en la legislación de urbanismo de Aragón vigente.
  • Realización de ejercicios de reparcelación de una unidad de ejecución.
  • Visualización y crítica de videos de actuaciones urbanísticas recientes tanto de desarrollo de suelo urbanizable como de transformación de suelos urbanos no consolidados.

5. Sistema de evaluación

La evaluación del aprendizaje del alumno se llevará a cabo atendiendo a dos aspectos:

  • valoración de los conocimientos teórico-prácticos del alumno y
  • defensa oral de un trabajo. 

Normas respecto al trabajo:

El trabajo se centrará en el análisis y comentario de un instrumento de planeamiento urbanístico en vigor.

El trabajo se presentará por escrito y se defenderá oralmente.

La nota del trabajo representará un 20% de la nota de la asignatura.

Para la valoración de esta prueba se tendrá en cuanta la capacidad de síntesis, la claridad de la exposición, el uso ágil de terminología especializada y la utilización de medios audiovisuales adecuados.

Normas valoración de los conocimientos teórico-prácticos:

Para obtener una valoración positiva, el alumno deberá superar una de estas dos condiciones:

  • Aprobar un examen final (obtener una calificación de  5 o superior) a celebrar en la fecha oficial del calendario de exámenes. 
  • Aprobar dos controles parciales que se realizarán a lo largo del curso (obtener una media de 5 entre los dos; no se aplicará esta regla si alguno de ellos es valorado por debajo de 4).

En la valoración de esta parte se tendrá en cuenta no sólo la adecuación de las contestaciones del alumno al contenido de la asignatura, sino también la claridad gramatical y ortográfica en la exposición del mismo.

La nota de esta parte representará el 80% de la nota de la asignatura
